Inspiring Conversations with Darren Heitner of Heitner Legal

Today we’d like to introduce you to Darren Heitner.

Hi Darren, it’s an honor to have you on the platform. Thanks for taking the time to share your story with us – to start maybe you can share some of your backstory with our readers?
Darren graduated from the University of Florida in 2007 with a degree in Political Science, magna cum laude, where he was named Valedictorian of the College of Liberal Arts and Sciences, and earned his law degree from the University of Florida Levin College of Law in 2010.

While still in college in 2005, he started the “Sports Agent Blog,” which became a go-to place for sports business news. He gained an internship at Career Sports & Entertainment, a full-service sports and entertainment company in Atlanta, GA, during the summer between his sophomore and junior year of undergrad.

After law school, Heitner worked at other firms for several years before making his move. He also founded Dynasty Athlete Representation, representing professional bowlers, college coaches, baseball players, and others.

In 2014, he launched Heitner Legal to provide more personalized service and bring his passion for law and client advocacy to the forefront.

He’s now recognized as one of the nation’s foremost authorities on Name, Image, and Likeness (NIL) rights. He’s also taught at multiple universities, written a book on sports law, and contributed to Forbes and Inc. Magazine.

I’m sure it wasn’t obstacle-free, but would you say the journey has been fairly smooth so far?
No, it definitely wasn’t a smooth road. Money was a major concern when choosing schools – his mother was a private school teacher and his father a real estate agent, so he wouldn’t have his way paid for him. It was very difficult to break into the field of Sports Law, particularly as a sports agent in his early years as a professional. He was constantly scared that clients would grow to the point where they’d be taken away by competitors. While in law school, he not only studied for his courses but was simultaneously recruiting and servicing clients for his own agency, Dynasty Athlete Representation. He continued this even after graduating, while working as an associate attorney. His blog, Sports Agent Blog, started with only 30-40 people reading his content for the first few months before it slowly gained traction through sharing. He made a New Year’s resolution to write every weekday and stuck to it, even when few people were reading. His success came from persistence through uncertainty, not from an easy path.

Great, so let’s talk business. Can you tell our readers more about what you do and what you think sets you apart from others?
Heitner Legal is a boutique law firm established in 2014 specializing in sports law, intellectual property, and entertainment law. With Sports Law, Heitner Legal focuses on representation for athletes, agents, coaches, brands, collectives, gaming entities, and sports organizations – from NIL deals and endorsement contracts to league disputes and agent regulations. Concerning Intellectual Property, it helps with the protection of creative works, innovations, and brand identity through strategic copyright, trademark, and patent solutions, plus defending against infringement and enforcement when IP is misappropriated. For Entertainment Law, the firm provides services for artists, musicians, performers, producers, managers, and content creators. On the Business Law side, Heitner Legal offers guidance for entrepreneurs, startups, and established businesses on formation, contracts, compliance, and strategic growth.

Darren is widely recognized as one of the nation’s foremost authorities on Name, Image, and Likeness (NIL) rights. In 2019, he was personally selected by Florida Representative Chip LaMarca to draft groundbreaking legislation that changed collegiate athletics. The resulting Florida bill was signed into law by Governor Ron DeSantis in June 2020, making Florida the first state to establish a July 1, 2021 effective date.

He’s represented elite athletes, including Pro Football Hall of Famer Terrell Owens, Heisman Trophy Winner Johnny Manziel, NFL stars like JuJu Smith-Schuster, Tyreek Hill, and Jalen Hurts, NBA stars like Draymond Green, MLB stars like Shane Bieber and Trevor Bauer, and NIL pioneers like the Cavinder Twins and Angel Reese.

Most clients stay with Heitner Legal long-term because they appreciate the personalized approach to solving unique challenges. Often, a request begins with completing a single task and grows into an ongoing outside general counsel relationship.

Their brand tagline is telling: “People tend to hate lawyers. Our clients love us.”

In 2023, Sports Business Journal recognized Heitner Legal as the only law firm “Power Player” in NIL, and Darren was named to the Top 25 Most Influential Figures in NIL

Darren authored “How to Play the Game: What Every Sports Attorney Needs to Know” for the American Bar Association (3 editions: 2014, 2018, 2021) and serves as an adjunct professor at the University of Miami School of Law and the University of Florida Levin College of Law.

Can you talk to us about how you think about risk?
As mentioned earlier, right before starting law school, he built Dynasty Athlete Representation from scratch. Over the next three years, he not only studied for his courses but was also recruiting and servicing clientele while attending law school full-time. This was a significant risk – juggling legal education with building a business.

In June 2014, after years of working at other law firms, he determined it was time to create his own and bring his passion for the law and serving clients to the forefront of a new practice. Leaving the stability of established firms to start Heitner Legal was a major entrepreneurial risk.

In 2005, as a 20-year-old undergraduate, he decided to be the first at providing sports agency news and information through Sports Agent Blog. For the first few months, only 30-40 people were reading his content, but he committed to writing every weekday. He invested significant time and effort with no guarantee of payoff.

As an undergraduate, Heitner worked as a nightlife promoter and eventually started his own promotion company, giving him early entrepreneurial experience and teaching him about risk-taking in business.

The consistent theme is that his risks weren’t reckless – they were strategic moves where he positioned himself uniquely in markets with growth potential.
